Our debt collectors are trained to be firm and persistent and will pursue your debtors with skill and enthusiasm, utilising cutting edge technology and significant industry experience to ensure that you get the maximum possible return on your overdue monies.
After informing your debtor in writing that we have been instructed, we will instigate a robust recovery strategy that includes sending regular direct communications such as e-mails, faxes and SMS text messages to encourage settlement. These actions are used alongside the tried and tested debt collection activities such as persistent telephone calls, Letters Before Action, and the extremely effective action of sending field agents to your debtor’s residence or premises to discuss and obtain repayment.
Should this action not result in payment, then legal action is often the sure fire way of bringing errant payers to account.
Legal Services
CDS has a successful in-house Legal Department with a wealth of experience in civil litigation. The services of our legal team can be utilised without incurring the often unnecessary expenses of a separate firm of solicitors or a barrister.
Over 80% of legal action is dealt with by the County Courts, and most of the debt cases issued there are relatively straightforward. Should legal action be necessary against your debtors, you can be safe in the knowledge that you will receive a quality service with your best interests at heart.
Methods of Enforcement
Bailiffs
Dependent on the type of Judgment that you have, we can instruct either a County Court Bailiff with a Warrant or a High Court Enforcement Officer (Sheriff) with a Writ to seize personal or business goods for sale at public auction to satisfy the debts owed to you.
Charging Orders
If your debtor owns a property with sufficient equity, it may be prudent to secure the debt by way of a legal charge. You would then own a share in the property and once it is sold, the debt is paid from the proceeds of sale. Should the property not be promptly sold, a request to the Court for an Order for Sale may be appropriate.
Attachment of Earnings
Should your debtor be in regular PAYE employment, we can apply to the Court to deduct weekly or monthly sums from their salary.
Third Party Debt Order
If a third party organisation or individual holds any money on behalf of the debtor, it is possible to apply to the Court for those funds to be frozen and diverted to you in satisfaction of the debt. This is useful if you know there to be funds in the debtor’s bank account.
Oral Examination
Although not strictly a method of enforcement, it can force a debtor into Court to explain why they have not paid the Judgment. It is a useful tool for obtaining information about the debtor’s financial circumstances in order to determine a suitable enforcement.
Process Serving
CDS are able to effect personal service of Court documents on any individual or company officer anywhere in England and Wales. An Certificate of Service can be provided as part of this service.
